White River Tribal Tax Credit Investors May Be Entitled to a Financial Recovery
NEW YORK, NY, UNITED STATES, October 22, 2026 /EINPresswire.com/ — National investment loss and securities law firm KlaymanToskes announces the filing of a Financial Industry Regulatory Authority (“FINRA”) arbitration claim against Kingswood Capital Partners, LLC. The claim, FINRA Case No. 26-02307, seeks approximately $200,000 on behalf of a couple who allegedly suffered investment losses and tax-related damages arising from White River Tribal Tax Credits recommended by Kingswood financial advisor Joseph Wainer (CRD# 7551069).
KlaymanToskes currently represents many White River Energy and Tribal Tax Credit investors seeking to recover investment losses, tax liabilities, penalties, interest, and other damages. Investors who purchased White River Tribal Tax Credits or similar products through Wainer, Kingswood, or another financial professional are encouraged to contact KlaymanToskes at 888-997-9956 or investigations@klaymantoskes.com for a free and confidential consultation to discuss their potential recovery options.
According to the Statement of Claim, the investors informed Wainer that the funds were savings intended for their children’s college education and needed to be invested conservatively. Wainer allegedly recommended that they pay $120,000 for $200,000 in purported White River Tribal Tax Credits, representing that the transaction was low-risk and would generate a $200,000 federal tax refund.
The claim alleges that the anticipated refund was never issued and that the IRS subsequently disallowed the claimed credits, requiring the investors to retain tax counsel. It further alleges that the investors were not adequately advised that the purported credits lacked clear authority under federal tax law, could be rejected by the IRS, and could expose them to the complete loss of their investment, additional tax liabilities, penalties, interest, and professional expenses.
In September 2026, the IRS warned that products marketed as “Tribal Tax Credits,” “Native American Tax Credits,” or “Sovereign Tribal Tax Credits” do not exist under federal law. The IRS further cautioned that taxpayers claiming such credits may be responsible for the correct taxes owed, penalties, interest, and potentially other consequences.
“Investors should be able to rely on their financial professionals to thoroughly investigate a purported tax credit before recommending that they use college, retirement, or other important savings to purchase it,” said Lawrence L. Klayman, Managing Partner of KlaymanToskes. “When these products fail, investors may face damages extending far beyond the amount invested, including tax liabilities, penalties, interest, and legal and accounting expenses.”
As of October 20, 2026, Wainer’s current FINRA BrokerCheck report reflects no disclosure events. He entered the securities industry in 2022 and has been registered with Kingswood Capital Partners since May 2023. Separately, FINRA censured Kingswood and fined the firm $150,000 in December 2025 based on findings involving its supervision of alternative investment recommendations.
Investors who suffered losses or other damages involving White River Tribal Tax Credits are encouraged to contact KlaymanToskes at 888-997-9956 or investigations@klaymantoskes.com to discuss their potential recovery options.
